| Abstract: | พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว พ.ศ. 2550 มีวัตถุประสงค์เพื่อ กำหนดรูปแบบ วิธีการ และขั้นตอนการดำเนินคดีความรุนแรงในครอบครัวที่มีลักษณะแตกต่างจากคดีอาญาทั่วไปอันเนื่องมาจากความสัมพันธ์ระหว่างผู้กระทำและผู้ถูกกระทำ โดยมุ่งเน้นให้ผู้กระทำความผิดมีโอกาสกลับตัว ยับยั้งการกระทำความผิดซ้ำ รวมทั้งรักษาความสัมพันธ์อันดีระหว่างบุคคลในครอบครัวไว้ได้มากกว่าการลงโทษผู้กระทำผิด จากการศึกษาพระราชบัญญัติคุ้มครองผู้ถูกกระทำความรุนแรงในครอบครัว พ.ศ. 2550 พบว่าได้กำหนดให้ศาลมีบทบาทในการพิจารณาคดีและมีคำสั่งต่างๆ อาทิ อนุญาตให้ผัดฟ้องอนุญาตให้ออกหมายขัง ออกคำสั่งกำหนดมาตรการหรือวิธีการเพื่อบรรเทาทุกข์ กำหนดวิธีการอย่างอื่นแทนการลงโทษ และมีบทบาทเกี่ยวกับการยุติคดี แต่บทบัญญัติของกฎหมายฉบับนี้ยังเป็นประเด็นปัญหาที่สร้างความเข้าใจที่ไม่ตรงกันสำหรับเจ้าพนักงานตำรวจ พนักงานเจ้าหน้าที่ พนักงานอัยการ และผู้พิพากษาซึ่งเป็นผู้บังคับใช้พระราชบัญญัติฉบับนี้โดยตรง วิทยานิพนธ์ฉบับนี้ได้เสนอแนวทางในการแก้ไขบทบัญญัติแห่งกฎหมายตามพระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว พ.ศ. 2550 โดยแก้ไขบทบัญญัติแห่งกฎหมายให้เกิดความชัดเจนสำหรับบุคคลากรที่เกี่ยวข้องในกระบวนการยุติธรรมทางอาญาเกี่ยวกับความรุนแรงในครอบครัวให้มีความเห็นทางกฎหมายที่เป็นไปในทางเดียวกันโดยเฉพาะผู้พิพากษาซึ่งมีบทบาทสำคัญในการอำนวยความเป็นธรรมในคดีความรุนแรงในครอบครัว เพื่อให้กฎหมายฉบับนี้เกิดผลในการบังคับที่สอดคล้องกับเจตนารมณ์ของกฎหมายได้อย่างมีประสิทธิภาพสูงสุดและเพื่อให้การพิจารณาคดีความรุนแรงในครอบครัวเป็นไปในแนวทางเดียวกัน |
| Other Abstract: | Domestic Violence Victim Protection Act B.E. 2550 was legislated in order to from special criminal litigation in relation to domestic violence cases which are distinct from ordinary criminal cases because of the relationship between offenders and aggrieved parties. This act emphasizes on wrongdoer reforming, recidivism prevention and family members restoration more than focuses on offender punishment. From the study, the Domestic Violence Victim Protection Act B.E. 2550 provides the relevant judges to exercise authorities at their sole direction (e.g. to permit the action postponement requests, to issue warrants of detentions, to issue protection orders, to decide other measures replacing the original criminal punishments, and settle disputes between the parties). Nonetheless, certain articles in this act cause misunderstanding and contradiction in interpretation to police officers, public officers, public attorneys and judges which are the law enforcer. This thesis is subject to present the resolution by review certain articles in the act that may lead to ambiguity. The amendment of law could assist and guide the domestic violence criminal justice partners, particularly judges, to interpret the laws and judge domestic violence cases in the same procedure. Besides, the revision shall provide proficient and effective law enforcement that attain to the Domestic Violence Victim Protection Act B.E. 2550's purpose. |
