User Rights
CUIR has announced the right to use digital files in our database according to Creative Common Attribution-NonCommercial-NoDerivatives 4.0 (CC BY-NC-ND 4.0) The users are free to use the resources as long as the sources are cited. It is for non-commercial purposes and there are no adaptations. The Creative Commons logo has already been on CUIR website. The users are able to follow the link at the logo to Creative Commons website for the details of public copyright licenses or find them at https://creativecommons.org/licenses/by-nc-nd/4.0/
In order to remind the users about the Terms of Use, pop-up window will appear after download link was clicked with the message that reads “These documents are reserved for educational use only, no commercial use or adaptation are allowed. Citations of the author are always required.” The users need to click OK to continue downloading process.
Execution Measure and Guideline for Misuse of CUIR Information Resources
Office of Academic Resources provides open access repository as to distribute knowledge and resources of Chulalongkorn University communities or resources that Chulalongkorn University reserves rights and/or resources that Chulalongkorn University reserve rights to publish to the aim of study and research.
Office of Academic Resources only allows users to download and share CUIR information resources with credit/reference and without changing information in any way or use for commercial purposes. If any misuse of CUIR information resources was found, the Office of Academic Resources will act as follows:
1. Notice to the wrongdoer to stop misusing content and to withdraw any resources which is the result of misuse of CUIR information resources. (If already published)
2. If any resources which is the result of misuse of CUIR information resources was published by any organization, Office of Academic Resources will notify that organization to withdraw those resources.
3. If the wrongdoer is not giving any cooperation, Office of Academic Resources will report the case to university lawyer unit (Center of Law and Legal Affairs) to take action in accordance with the law.
สิทธิ์การใช้งานคลังปัญญาจุฬาฯ
คลังปัญญาจุฬาฯ ได้มีการประกาศสิทธิ์การใช้งานไฟล์ดิจิทัลในคลังปัญญาจุฬาฯ ด้วยสัญญาอนุญาตการใช้งานแบบเปิด Creative Common Attribution-NonCommercial-NoDerivatives 4.0 (CC BY-NC-ND 4.0) คือ ให้เผยแพร่ได้ โดยต้องอ้างอิงแหล่งที่มา ห้ามนำไปใช้เพื่อการค้า และห้ามดัดแปลง โดยได้นำรูปของสัญญาอนุญาตดังกล่าวมาติดไว้ที่หน้าเว็บไซต์คลังปัญญาจุฬาฯ แล้ว ผู้ใช้บริการสามารถคลิกที่รูปเพื่อลิงค์ไปยังหน้าเว็บไซต์ของ Creative Commons เพื่ออ่านรายละเอียดการอนุญาตให้ใช้สิทธิ หรือสามารถดูได้ที่ https://creativecommons.org/licenses/by-nc-nd/4.0/
ทั้งนี้เพื่อให้ผู้ใช้นำไฟล์ดิจิทัลไปใช้ตามเงื่อนไขของสิทธิ์ที่ได้ประกาศไว้ ทางคลังปัญญาจุฬาฯ ได้ทำเป็น Pop-up เตือน เมื่อผู้ใช้คลิกดาวน์โหลด เป็นข้อความว่า “เอกสารที่กำลัง Download เป็นเอกสารที่สงวนไว้สำหรับการใช้งานเพื่อการศึกษาเท่านั้น ไม่อนุญาตให้นำไปใช้ประโยชน์ด้านการค้า ไม่ว่ากรณีใดๆ ทั้งสิ้น อีกทั้งห้ามมิให้ดัดแปลงเนื้อหา และต้องอ้างอิงถึงเจ้าของเอกสารทุกครั้งที่มีการนำไปใช้ This material is reserved for educational use only, not allowed for commercial use. Forbidden to modify the content, and cite the document when use.” ซึ่งผู้ใช้งานจะต้องทำการคลิกปุ่ม OK เพื่อรับทราบเงื่อนไขดังกล่าวก่อนทำการดาวน์โหลดไฟล์
มาตรการและแนวทางดำเนินการใช้งานทรัพยากรสารสนเทศผิดเงื่อนไข
สำนักงานวิทยทรัพยากร ให้บริการคลังสารสนเทศแบบเปิดโดยมีวัตถุประสงค์เพื่อการเผยแพร่ความรู้และสารสนเทศที่เกิดจากภูมิปัญญาของประชาคมจุฬาลงกรณ์มหาวิทยาลัย หรือที่เป็นลิขสิทธิ์ของจุฬาลงกรณ์มหาวิทยาลัย และ/หรือสารสนเทศที่จุฬาลงกรณ์มหาวิทยาลัยได้รับสิทธิหรือมีสิทธิในการเผยแพร่ ทั้งนี้เพื่อเป็นประโยชน์ในการศึกษาค้นคว้าวิจัยทั้งในแวดวงวิชาการและการเผยแพร่ความรู้สู่สังคม
สำนักงานวิทยทรัพยากร ไม่อนุญาตให้นำข้อมูลที่ปรากฏในคลังสารสนเทศไปใช้เพื่อประโยชน์ในทางการค้า รวมถึงไม่อนุญาตให้ดัดแปลงผลงานโดยไม่ได้รับอนุญาตจากเจ้าของผลงาน และต้องมีการอ้างอิงเอกสารทุกครั้งเมื่อมีการนำไปใช้ ทั้งนี้หากสำนักงาน ฯ พบ หรือได้รับแจ้งว่ามีการนำผลงานที่ปรากฏในคลังสารสนเทศไปใช้โดยไม่เป็นไปตามเงื่อนไขและข้อกำหนดของสำนักงานวิทยทรัพยากร สำนักงาน ฯ จะดำเนินการ ดังนี้
1. ทำหนังสือแจ้งเตือนไปยังผู้กระทำผิดเงื่อนไขและข้อกำหนดให้หยุดการกระทำที่ผิดเงื่อนไขและข้อกำหนด รวมถึงให้ระงับการเผยแพร่ผลงานที่เกิดจากการกระทำที่ผิดเงื่อนไขและข้อกำหนด (หากมีการเผยแพร่ผลงานดังกล่าวแล้ว)
2. กรณีที่ผลงานที่กระทำผิดเงื่อนไขและข้อกำหนด ได้มีการเผยแพร่โดยห้องสมุด หน่วยงาน หรือองค์กรต่าง ๆ สำนักงาน ฯ จะทำหนังสือแจ้งขอความร่วมมือไปยังห้องสมุด หน่วยงาน องค์กรเหล่านั้น เพื่อระงับการเผยแพร่ผลงานดังกล่าว
3. หากผู้กระทำผิดเงื่อนไขและข้อกำหนดไม่ให้ความร่วมมือ สำนักงาน ฯ จะแจ้งข้อมูลดังกล่าวไปยังฝ่ายนิติการ เพื่อดำเนินการเอาผิดตามกฎหมายต่อไป
